Yandy SMS Program Terms and Conditions

By opting-in to the Program (as defined below), you agree to these ASP RETAIL GROUP LLC's ("Yandys" including its affiliated entities, "we", "us" or "our") SMS Program Terms and Conditions ("Terms and Conditions"), Yandy's Terms of Service [(which includes a mandatory arbitration provision and class action waiver)] and Yandy's Privacy Policy.

You are not required to opt-in to the Program in order to purchase any goods or services from Yandys.

Program Description

Yandys provides recurring promotional and personalized marketing text messages, such as shopping cart reminders and promotions, to its customers and potential customers (the "Program"). Message frequency may vary. Text messages may be sent by an automated system. We reserve the right to change the short code or phone number from which messages are sent and we will notify you if we do so.

How to Opt-in

You may opt in to the Program by visiting yandy.com, providing your cellular telephone number in the space provided and agreeing to terms presented on the website (including these Terms and Conditions). If you are on a mobile device, you will be prompted to provide your telephone number to us by sending a confirmation text message to us.

How to Opt-out/Cancel

To opt-out, you may text "STOP" to +1-207-306-7333 or, if we notify you that we will no longer be using this number or any other number to send messages under the Program, to any subsequent number that replaces the number then being used (the "Program Number"). You may also opt-out by texting by sending the words "QUIT," "END," "CANCEL," or "UNSUBSCRIBE" to the Program Number. Once you opt-out, we will send a single confirmation opt-out and will then cease sending you Program text messages from the Program Number unless you opt-in again. Opting out of Program's text messages will not opt you out of other text messages you may have elected or will elect to receive from us. You acknowledge that our text message platform may not recognize and respond to unsubscribe requests that (i) do not include the keyword commands identified in this section or (ii) that are sent to a number that is no longer being used (after you have been notified that the number will no longer be used) and agree that we and our service providers will have no liability for failing to honor such requests.

Delivery

We do not guarantee that you will receive any text messages under the Program. Circumstances beyond our control, including network issues, may result in your not receiving our text message. Neither we nor your carrier are liable for delayed or undelivered text messages.

We are able to deliver messages to the following mobile phone carriers: Major carriers: AT&T, Verizon Wireless, Sprint, T-Mobile, MetroPCS, U.S. Cellular, Alltel, Boost Mobile, Nextel, and Virgin Mobile. Minor carriers: Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Cellular One of East Central IL (ECIT), Cellular One of Northeast Pennsylvania, Cincinnati Bell Wireless, Cricket, Coral Wireless (Mobi PCS), COX, Cross, Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Mosaic (Consolidated or CTC Telecom), Nex-Tech Wireless, NTelos, Panhandle Communications, Pioneer, Plateau (Texas RSA 3 Ltd), Revol, RINA, Simmetry (TMP Corporation), Thumb Cellular, Union Wireless, United Wireless, Viaero Wireless, and West Central (WCC or 5 Star Wireless).

The Program is intended for use by U.S. residents who are at least 18 years of age.

Privacy

Your privacy is our priority. We will never, under any circumstances, sell your cell phone number to third parties without your prior consent and approval. We will never distribute personal information collected about you through the Program, including your phone number, name, billing information or any other piece of identifying information without your prior consent and approval.For additional information about how we collect, use, and share personal information, please review our Privacy Policy.

Changes to these Terms and Conditions

We may revise, modify, or amend these Terms and Conditions at any time. Any such revision, modification, or amendment shall take effect when it is posted to our website. You agree to review these Terms and Conditions periodically to ensure that you are aware of any changes.

Changes to Your Telephone Number

In the event that you change or deactivate your telephone number, it is your responsibility to notify us at service@yandy.com to have the number removed from the Program.

Consent to Electronic Disclosures

You agree that we may provide disclosures relating to the Program to you electronically. You may withdraw your consent to receive electronic disclosures by contacting us at service@yandy.com. Withdrawing your consent will not impact any disclosure we have previously given to you. To update your contact information or obtain a free paper copy of any disclosure we would otherwise be required to provide to you in writing, you may contact us at service@yandy.com. You understand that you need a computer or mobile device with Internet access and a recent-generation browser to view electronic disclosures and a printer or storage device to save it.

CostWe do not charge any fees for participation in the Program. However,message & data rates may apply.

Program Termination: We reserve the right to modify or discontinue, temporarily or permanently, all or any part of the Program, with or without notice.
